conditions are intended to assist keep Posh Studio a safe and pleasurable
place to visit.
1.1 Acceptance of Terms and Conditions: The terms and conditions are the
terms on which Posh Studio offers you access its Services and the Website. By
using these services you accept these terms and conditions. If you do not
accept these terms and conditions, you must refrain from using the Services.
1.2 Amendment of Terms and Conditions: These terms and conditions may
be amended in whole or in part by Posh Studio from time to time. Amendments
will be effective immediately upon posting of the amended terms and conditions
on this Website. You are responsible for ensuring you are familiar with the latest
terms and conditions. Your continued use of the Services represents your
agreement to be bound by the terms and conditions as amended.

2. GENERAL PROVISIONS
2.1 Intellectual Property Rights: Posh Studio (and its licensor's or
suppliers, as the case may be) owns all proprietary and intellectual property
rights in the Website (including text, graphics, logos, icons and sound
recordings) and the software and other material underlying and forming part of
the Services and the Website.
You may not without our prior written permission, in any form or by any means:
a) Adapt, reproduce, copy, store, distribute, print, display, perform, publish or
create derivative works from any part of this Website; or
b) Commercialise, copy, or on-sell any information, or items obtained from any
part of this Website.
3. PRIVACY POLICY
Posh Studio has created this privacy statement in order to demonstrate our firm
commitment to privacy. This statement discloses our information gathering and
usage practices.
3.1 Use of your information: Posh Studio does not sell or rent your personal
information to third parties for any reason.
Under the new Unsolicited Electronic Messages Act 2007, it is important that we
have your prior consent to receiving electronic email messages from Posh
Studio. As such Posh Studio will from time to time request a response from its
customers as to whether they wish to receive such communications.
Posh Studio will from time to time publish promotional offerings to existing and
previous customers if they have provided permission as above.
Posh Studio reserves the right to use customer feedback from any source to
promote its products and services on this website.
4. DISCLAIMER
4.1 Change in Services: Posh Studio reserves the right to change the prices
charged for any of our Services or Products at any time. In the event that we
introduce a new service or product, the prices for that service or product are
effective its the launch, unless otherwise stated.
4.2 Alterations: Posh Studio advises customers that alterations to the
finished dress may be required at the customers own expense for a more
accurate fit as all body shapes are unique. Posh Studio bears no responsibility
for products made to the measurements supplied by the customer.
If a fitting was not done in the studio and the dress was made based on
measurements provided by the customer, Posh Studio will make the dress to
the measurements provided rather than a "perfect fit" based on body shape.
4.3 Force Majeure: While Posh Studio endeavours to deliver its services
and products on time, it shall in no way be held responsible for the late or non
delivery of its services and products caused by events outside of its direct
control.
5. REFUND POLICY
5.1 Refunds: Posh Studio encourages customers to visit our studio to view
the style/s, fabric/s and colour/s before deciding and purchasing. For this
reason, customers who cannot visit the studio should be certain of their choice
of style, fabric, colour and measurements as refunds are only applicable in the
case of manufacturing defects. Change in taste / mind or "the dress doesn't look
good on me" do not constitute valid reasons for a refund.
Posh Studio prides itself in making accurate representation of its products
online. However, we recognize, and encourage our customers to bear in mind,
that the colour swatches may vary slightly depending on computer monitor
settings.
To avoid potential disappointment, Posh Studio strongly recommends that its
customers avoid placing partial orders over a period of time for the same event
to eliminate the possibility of any fabric colour differences. This may result from
making the dresses from different batches of fabric. Fabric produced in different
batches may differ slightly in colour even under the same colour code. Orders
placed in this manner, resulting in colour variations, will not constitute valid
reason for a refund.
Please note that any request for a qualified refund will only be available for a
period of two weeks following the pick up or delivery of the dress/es. Any request
for a refund after this time will be rejected.
6. CANCELLATION POLICY
6.1 Cancellations: In the unlikely event that a customer wishes to cancel
their order, the following conditions will apply:
a) Any cancellation made prior to the customer order being placed on the factory
by Posh Studio will incur a 20% cancellation fee under all circumstances.
b) Any cancellation made after the customer order has been placed on the
factory will incur a 100% cancellation fee.
7. HIRE POLICY
7.1 Bond: A bond is required for all dress hire contracts and will be fully
refunded on return of the dress and any accessories on time and in original
condition.
7.2 Late Fees: A nominal late fee charge of $25.00 will be incurred if the
goods are not returned on time per the due date on the contract.
7.3 Damage: Any damage to the dress or accessories will incur a fee
dependant on the level of damage and at the discretion of Posh Studio
management.
8. QUOTATION POLICY
8.1 Quote: All quotes will be confirmed in writing, normally by email.
8.2 Expiration: The quote will be valid for 28 days only. A new quote will be
required after this period.
